Our refund and liability policy is designed to provide clarity and transparency for all transactions conducted through Simple Lend Marketplace. It is crucial for buyers to thoroughly review these terms before making any purchase. Understanding these policies helps in making informed decisions and ensures that both parties are aware of their rights and obligations. Please note that all deposits and fees are non-refundable, and any cancellations post-payment do not qualify for a refund. Familiarize yourself with these guidelines to avoid any misunderstandings.

At Simple Lend Marketplace, all deposits and fees associated with transactions are strictly non-refundable. This policy ensures clarity and commitment from all parties involved. If a cancellation occurs after payment, no refund will be issued. Unauthorized chargebacks or payment disputes may lead to account suspension and the recovery of any related fees or costs incurred during the process.
Transfer of Risk and Liability
Once a vehicle or equipment is released to the buyer or their designated carrier, the risk of loss transfers as per the applicable agreement. Simple Lend Marketplace does not assume responsibility for any transit damage, delivery delays, or logistics issues that may arise. These occurrences do not entitle the buyer to a refund or create any liability obligation for Simple Lend.
It is crucial for buyers to arrange appropriate insurance and confirm all transport details to mitigate potential risks. Our role is to facilitate the transaction, and we encourage buyers to perform due diligence to ensure a smooth delivery process.
In the event of any transport-related issues, buyers should directly address these with the carrier or transport service provider. Simple Lend Marketplace remains committed to providing support where possible, but the ultimate responsibility lies with the buyer and their chosen service providers.

Refund & Liability Policy
Effective date: October 3, 2025
1) Marketplace Role (No Seller Responsibility)
Simple Lend (“Simple Lend,” “we,” “our,” or “us”) operates an online marketplace that connects buyers with independent third-party sellers of trucks and equipment. We are not a dealer or the seller of record.
All information about listings (including condition, specs, pricing, availability, title, mileage, and delivery) is provided and fulfilled solely by the respective sellers.
2) No Refunds
All payments related to purchases, deposits, application fees, listing/marketing/concierge fees, inspection coordination, and any other services transacted through or in connection with Simple Lend are non-refundable to the maximum extent permitted by law. Third-party services (e.g., inspections, transport, escrow, financing, payment processors) have their own terms and handle any refund requests directly.
3) “AS IS / WHERE IS / WITH ALL FAULTS”
All vehicles/equipment are sold by the respective sellers strictly “AS IS,” “WHERE IS,” and “WITH ALL FAULTS.”
Simple Lend does not own, inspect, recondition, certify, warrant, or guarantee any vehicle/equipment and assumes no responsibility for defects, nonconformities, delays, or statements made by sellers.
4) Buyer Due Diligence
Buyers are solely responsible for their own due diligence before purchase, including (as applicable): independent mechanical inspections/diagnostics; title, lien, emissions, and registration verification; confirmation of specifications and prior use; and arranging/confirming transport and insurance. Declining an inspection does not create any refund or cancellation right.
5) Deposits, Fees & Cancellations
All deposits and fees are non-refundable.
Canceling after payment does not entitle a buyer to a refund from Simple Lend.
Unauthorized chargebacks/payment disputes may result in account suspension and recovery of related fees/costs.
6) Transport, Delivery & Risk of Loss
Risk of loss transfers per the applicable agreement once a vehicle is released to the buyer or the designated carrier. Transit damage, delivery delays, or logistics issues do not create any refund or liability obligation for Simple Lend.
7) Warranty Disclaimer (No Warranties)
To the maximum extent permitted by law, Simple Lend disclaims all warranties—express, implied, statutory, or otherwise—including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or quiet enjoyment.
Marketplace content and services are provided on an “AS IS” and “AS AVAILABLE” basis.
8) No Liability for Seller Acts/Statements
To the maximum extent permitted by law, Simple Lend is not liable for any seller act, omission, misrepresentation, nondisclosure, or breach, including with respect to: condition, odometer/mileage, title/lien status, accidents, prior damage/repairs, frame/rust issues, emissions compliance, or any latent/patent defect.
9) Limitation of Liability
To the maximum extent permitted by law, Simple Lend will have no liability for any indirect, incidental, special, consequential, exemplary, punitive, or multiplied damages, or for lost profits, lost revenue, loss of goodwill, or business interruption, even if advised of the possibility.
Where a limitation cannot legally be excluded, Simple Lend’s total aggregate liability for any and all claims arising out of or related to the marketplace or services shall not exceed the lesser of (a) USD $100, or (b) the amount you paid directly to Simple Lend for the specific fee-based service giving rise to the claim in the three (3) months preceding the event.
10) Indemnification
You agree to defend, indemnify, and hold harmless Simple Lend and its officers, directors, employees, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use of the marketplace; (ii) your purchase, possession, transport, registration, or use of any vehicle/equipment; (iii) your breach of this policy or applicable law; or (iv) any dispute between you and a seller or third-party provider.
11) Misrepresentation/Fraud Reporting (Facilitation Only)
If you believe a seller engaged in material misrepresentation or fraud, notify us in writing within 48 hours of delivery/pickup with supporting evidence. At our sole discretion (and without obligation or liability), we may facilitate communications, refer you to the listing venue/payment platform, or provide information about potential remedies. This facilitation is not a promise of refund or responsibility by Simple Lend.
12) Third-Party Services & Processors
Escrow, inspections, transport, financing, and payment processing are provided by independent third parties under their own contracts. Simple Lend is not responsible for those services or their outcomes, funds flow, delays, or errors.
13) Non-Waivable Rights
Nothing here limits non-waivable consumer/statutory rights under applicable law. Where a specific law requires a remedy (and cannot be waived), that law controls only for that circumstance; otherwise, this policy applies.
14) Dispute Resolution
Disputes regarding a transaction are between buyer and seller and/or the relevant third-party provider or payment platform. Simple Lend may, but is not obligated to, assist with information exchange.
15) Changes to This Policy
We may update this policy by posting a revised version on simplelend.co. The revised version is effective on posting unless otherwise stated.
